Terms of Use

These Terms of Use (the “Terms”) govern the use of the Privacy Score iOS application and the privacyscore.fr website, both published by Skander BAHRI, a French sole proprietor (entrepreneur individuel) trading as CoDevelop (“CoDevelop”, “we”). They apply to any adult natural person using the app or the website (“you”, “the user”).

Using the app constitutes full acceptance of these Terms. If you disagree with any of their provisions, do not install the app, or uninstall it.

1. Purpose

The Privacy Score app is a tool for auditing an iPhone’s privacy footprint. You import into it the Apple Privacy Report exported from your device. The app parses that report locally, computes a 0-100 score, identifies detected trackers, and provides recommendations.

The privacyscore.fr website introduces the app, hosts the documentation, and publishes these legal documents.

2. Acceptance

These Terms are accepted by any act of use: downloading the app, opening it, importing a report, subscribing, or browsing the website. The applicable version is the one in force at the time of use, available inside the app and at privacyscore.fr/en/terms-of-use.

3. Access to the Service

3.1 Technical requirements

• An iPhone running iOS 17 or later.
• An active Apple ID is required to download the app from the App Store and to subscribe.
• The user must have enabled the Apple Privacy Report beforehand at Settings > Privacy & Security > App Privacy Report.

3.2 Availability

The service is provided on an “as is” basis and as a best-effort obligation. CoDevelop does not guarantee uninterrupted availability. Because the app is local, its operation does not depend on a CoDevelop-operated server; however, downloading and managing the subscription depend on App Store availability, which is Apple’s responsibility.

4. First Scan Free

The first import of an Apple Privacy Report, together with the resulting full audit (score, tracker lists, recommendations, history of that first scan), is free for life. You can review these results indefinitely without subscribing.

5. Auto-Renewable Subscription

To import a second report and beyond, a paid subscription is required.

5.1 Pricing tiers

CoDevelop offers two subscription plans:

Prices include all taxes (French VAT at the standard 20% rate). Apple may charge slightly different amounts depending on your region, in accordance with its own pricing grid.

5.2 Automatic Renewal (Article L. 215-1 of the French Consumer Code)

The subscription is auto-renewing. At the end of each term (12 months for the annual plan, 6 months for the six-month plan), the subscription is tacitly renewed for an identical new term, unless you cancel beforehand.

Under Article L. 215-1 of the French Consumer Code, you are informed that you may at any time decline to renew your subscription, without penalty, by following the cancellation procedure below, at the latest 24 hours before the end of the current term.

Apple, as payment processor and manager of In-App subscriptions, sends you a renewal notification ahead of each due date within the timeframe required by Article L. 215-1. This automatic notification satisfies the obligation that would otherwise fall on CoDevelop.

5.3 Cancellation

Cancellation is performed from iOS Settings:

Settings > tap your name > Subscriptions > Privacy Score > Cancel Subscription.

Cancellation takes effect at the end of the current term. You retain access to paid features until that date. CoDevelop cannot cancel your subscription for you, since management is handled entirely by Apple.

The Privacy Score application uses no user account on the CoDevelop side (no session, no publisher-side identifier), so cancellation necessarily goes through iOS Settings, which is the sole interface for managing In-App subscriptions. CoDevelop has no technical means to provide a direct cancellation feature. Article L. 215-1-1 of the French Consumer Code, which requires an online cancellation feature, is satisfied by the Apple-native path described above.

5.4 Refunds

Any refunds are handled by Apple under its own policy, available at https://www.apple.com/legal/internet-services/itunes/. CoDevelop receives neither your payment details nor your billing address and does not have the technical means to refund you directly. For any request, contact Apple through the “Report a Problem” page of your purchase history.

5.5 Right of Withdrawal

Under Article L. 221-28, 13° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium, where performance has begun with the user’s prior express consent and acknowledgment that they thereby waive the right of withdrawal. When you subscribe via Apple In-App Purchase, you give that prior consent and waive that right so as to receive the service immediately.

Apple sends you a confirmation email at the time of subscription summarizing the terms. This email satisfies the third condition required by Article L. 221-28, 13° c) and the second paragraph of Article L. 221-13 of the French Consumer Code.

6. User Obligations

You undertake to:

• Use the app and the website in accordance with applicable laws and regulations, in particular those relating to the protection of personal data.
• Refrain from attempting to decompile, disassemble, or extract the source code of the app beyond what is permitted by Article L. 122-6-1 of the French Intellectual Property Code.
• Refrain from circumventing the paid-subscription mechanisms.
• Refrain from using the app to analyze the Privacy Report of a third party without their consent.

7. CoDevelop’s Obligations

CoDevelop undertakes, as a best-effort obligation, to:

• Keep the app operational with supported recent iOS versions.
• Address reported anomalies within a reasonable timeframe.
• Keep this legal documentation up to date.

7.1 Service Quality Level

In accordance with Article L. 224-25-5 of the French Consumer Code, CoDevelop does not offer a minimum service-quality level (SLA) for the Privacy Score application. The application is provided on a best-effort basis, consistent with the standard usage of an iOS application distributed via the App Store.

7.2 Security Incidents

In the event of a security incident affecting the application, CoDevelop will publish a fix via the App Store as quickly as possible and, if the incident is likely to affect the confidentiality or integrity of data processed locally, will notify you via the application’s local notification function or by publication on the privacyscore.fr website. The breach-notification mechanism provided by the GDPR (Articles 33-34) applies in addition when its conditions are met.

7.3 Accessibility

The application complies with iOS accessibility guidelines (compatibility with VoiceOver, Dynamic Type, high contrast). Any significant accessibility update will be mentioned in the release notes published on the App Store.

8. Intellectual Property

The Privacy Score app and the privacyscore.fr website, as well as all their elements (source code, design, screenshots, illustrations, text, brand), are the exclusive property of Skander BAHRI / CoDevelop or its licensors, and are protected by copyright and trademark law.

Subject to your compliance with these Terms and to any required payment of your subscription, CoDevelop grants you a personal, non-exclusive, non-transferable, revocable license, strictly limited to private and non-commercial use on iOS devices of which you are the legitimate user.

Any reproduction or reuse beyond that scope is prohibited and exposes the user to the penalties of Articles L. 335-2 et seq. of the French Intellectual Property Code.

9. Personal Data

The processing of your data is described in the Privacy Policy, which together with these Terms forms a consistent contractual whole.

10. Liability

Because the app is an analysis and recommendation tool, the diagnostics it produces do not constitute legal, security, or financial advice. CoDevelop cannot be held liable for the decisions you may take based on those diagnostics.

CoDevelop may not be held liable for:

• App Store or Apple service unavailability;
• the consequences of an iOS update that modifies the Privacy Report format;
• third-party content (VPN or DNS providers listed for information).

In accordance with Article 1231-3 of the French Civil Code, the limitations above do not apply in the event of gross fault or willful misconduct by CoDevelop, nor to damages arising from harm to a person’s bodily integrity, in line with French public-order rules.

11. Affiliate Links

The app may reference third-party VPN or DNS providers for information and educational purposes. Some of these references are accompanied by affiliate links. If you subscribe to a service after clicking such a link, CoDevelop may earn a commission at no additional cost to you. This information is repeated on screen before each such click.

12. Changes to the Terms

CoDevelop may amend these Terms to reflect changes to the app, to the legal framework, or to its pricing. The version in force is always dated and numbered at the top of this page. Any material change (in particular regarding pricing) will be notified through the app or the website at least 30 days before it takes effect. You may then reject the new Terms by canceling your subscription before the effective date.

13. Termination by CoDevelop

CoDevelop reserves the right to suspend or terminate access to the service in the event of a material breach of these Terms, in particular subscription fraud or manifestly abusive use. Except in case of urgency, such termination will be preceded by a formal notice sent to support@privacyscore.fr that remains unanswered for 15 days.

14. Consumer Mediation

In accordance with the provisions of the French Consumer Code regarding “the consumer dispute mediation process” (Article L. 612-1 et seq.), after you have contacted us and in the absence of a satisfactory response, you may use a consumer mediation procedure free of charge with:

Mediation may only be initiated after you have first sent a written complaint to CoDevelop at support@privacyscore.fr that has remained unanswered.

You may also use the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

15. Governing Law and Jurisdiction

These Terms are governed by French law. In the absence of an amicable settlement, any dispute falls within the jurisdiction of the courts located in the district of the Tribunal judiciaire de Bordeaux.

These Terms constitute an adhesion contract within the meaning of Article 1110 of the French Civil Code. Any ambiguous clause shall be interpreted in favor of the user in accordance with Article 1190 of the same Code.

Where the user is a consumer residing in another EU Member State, Regulation (EU) No 1215/2012 (Brussels I bis) entitles them to bring proceedings, at their choice, before the courts of their place of residence or those of the Bordeaux Tribunal.
